Welcome to Ridgetop Homes. By accessing or using our services, you agree to comply with and be bound by the following terms and conditions. Please read these Terms of Service ("Terms") carefully before using our website and services. If you do not agree to these Terms, you should not use our services.
1. Definitions
- "Company," "we," "us," "our" refers to Ridgetop Homes.
- "Client," "you," "your" refers to the individual or entity using our services.
- "Services" refers to the custom home building services provided by Ridgetop Homes.
- "Agreement" refers to this Terms of Service agreement.
2. Scope of Services
Ridgetop Homes offers custom home building services including design, construction, and project management. Our services are detailed on our website and in individual project contracts.
3. Eligibility
To use our services, you must be at least 18 years old and capable of forming a legally binding contract. By using our services, you represent and warrant that you meet these requirements.
4. Project Terms
4.1 Contract Agreement
Each custom home project will be governed by a separate contract outlining the specific terms, scope, timeline, and costs. The contract must be signed by both the Client and Ridgetop Homes before the commencement of any work.
4.2 Changes and Modifications
Any changes to the project scope or design must be agreed upon in writing by both parties. Additional charges may apply for modifications requested after the project has begun.
4.3 Payment Terms
Payment terms will be specified in the individual project contract. Payments must be made in accordance with the schedule outlined in the contract. Failure to make timely payments may result in project delays or termination.
5. Warranties and Guarantees
Ridgetop Homes provides a limited warranty on our workmanship and materials used in the construction of your home. The specific terms of this warranty will be detailed in the project contract.
6. Limitation of Liability
To the maximum extent permitted by law, Ridgetop Homes shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with our services. Our total liability for any claims arising from the use of our services shall not exceed the amount paid by the Client to Ridgetop Homes for the specific project.
7. Termination
Either party may terminate the agreement with written notice if the other party breaches any material term of the agreement and fails to remedy the breach within a specified time frame. Ridgetop Homes reserves the right to terminate the agreement if the Client fails to make payments or otherwise hinders the project’s progress.
8. Dispute Resolution
Any disputes arising out of or in connection with this Agreement shall be resolved through good faith negotiations. If negotiations fail, the parties agree to submit the dispute to mediation or binding arbitration as determined in the individual project contract.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the state where the project is located, without regard to its conflict of law principles.
10. Changes to Terms
Ridgetop Homes reserves the right to modify these Terms at any time. Any changes will be posted on our website, and it is the Client’s responsibility to review these Terms periodically. Continued use of our services after any changes constitutes acceptance of the new Terms.
